Terms of Use

The owner of the website focus-economics.com (hereinafter, the “Website”) is FocusEconomics, S.L., a Spanish company with registered office at calle Gran Via de les Corts Catalanes, 657, 1º, 1ª, 08010, Barcelona, holder of Tax Identification Number B82162330, registered with the Commercial Registry of Barcelona (hereinafter “FocusEconomics”), whose contact e-mail address is: [info @ focus-economics.com].

These terms of use (hereinafter, the “Terms of Use”) regulate the use, including the mere access, to the Website, as well as the contents and services found therein. Any person who accesses this Website shall be considered its user (hereinafter the “User”) and expressly, automatically and voluntarily accepts the Terms of Use in force at the time of accessing the same, as well as the particular conditions that, where appropriate, may be applicable.

Obligations of the Users

In order to use the Website, the User must be legally entitled to contract and use the Website in accordance with these Terms of Use. The User shall make diligent use of the Website, in full compliance with the law, good practices, these Terms of Use and any other policy established by FocusEconomics for the Website. Likewise, the User shall be liable for the use made of the Website in his name or on behalf of third parties, unless it can be demonstrated that the fraudulent use does not result from any fault or negligence on his part.

By using the Website, the User also undertakes, and, in particular, to:

– respect the intellectual property rights of third parties;

– not to hinder or disrupt the proper functioning of the Website in any way and not to violate the integrity of the Website;

FocusEconomics reserves the right to deny access to the Website without prior notice to any User who uses the Website in a fraudulent manner or who breaches any of the provisions of these Terms of Use, the Law, public order or good practice, or who in any other way may disturb the good functioning, image, credibility and/or prestige of FocusEconomics or its collaborators. In such cases, FocusEconomics may demand liability from the Users for the damages derived from the misuse of the Website.

Exclusion of liability for the operation of the Website

FocusEconomics shall not be held responsible for the contents, files, information, advertising, opinions, concepts and images that do not depend on the Website, nor are managed by FocusEconomics. Therefore, FocusEconomics shall not assume any liability, whether direct or indirect, deriving from the misuse of the Website or its contents by the User, the latter assuming, in any case and under his exclusive responsibility, the consequences, damages or actions that may derive from his access or use of the Website or of the contents hosted, as well as from their reproduction or communication.

The Website may propose links to other web pages or other sources. FocusEconomics cannot control or check such external websites and sources. The links are provided “as is” simply for the User’s convenience.

FocusEconomics is therefore not responsible for the provision of such links that allow access to external websites and sources, and assumes no responsibility for the contents, advertising, products, services or any other data or information available on or from such external sites and sources.

FocusEconomics cannot guarantee the continuity of the service offered by the Website nor that it is permanently accessible, and therefore FocusEconomics declines all liability for damages of any nature that may arise from the availability and technical continuity of the operation of the Website. In any case, FocusEconomics shall carry out all the necessary actions to re-establish its services in the event of technical failure.

FocusEconomics shall also do everything possible to guarantee the reliability and confidentiality of the data available on the Website, but shall not be held liable, either criminally or civilly, for any possible breach of such confidentiality or for any other infringement, whatever its origin (technical difficulty, attacks carried out by a hacker, human error, etc.).

In no case shall FocusEconomics be liable for:

(ii) direct and/or indirect damages, or foreseeable or unforeseeable damages, resulting from the use of the Website or from the total or partial impossibility to access the Website;

(iv) any anomalies that may arise during the placing of an order, in the processing, due to causes attributable to the User, to an unforeseeable or insurmountable event of a third party outside the service, or in case of force majeure.

The present Terms of Use, as well as the Privacy Policy and the Cookies Policy of the Website will be applicable to the promotional activity as well as to the supply of information that is carried out through the Website and will regulate the navigation through the Website.

In view of the above, all personal information provided by the User through the Website will be collected, used and stored in accordance with the Privacy Policy of FocusEconomics, which forms an inseparable part of these Terms of Use. By providing personal information, the User agrees to the collection, processing, use and publication of such personal information in accordance with the Privacy Policy.

Access to and use of the Website implies acceptance of the aforementioned Terms of Use, Privacy Policy and Cookie Policy.

Intellectual and Industrial Property

The Website constitutes a work protected by intellectual property rights. FocusEconomics only authorizes the User to visualize its content in the personal and private scope. The private impression is authorized for the exclusive use of the User, being excluded any other use, as well as its diffusion or communication.

The above also applies to the structure, data and content appearing on the Website, in particular trademarks, logos, graphics, photos, and texts of any kind.

The Website and the information it provides are intended for the strictly personal use of the User and may not be reproduced, communicated to third parties, used in whole or in part, for commercial purposes or otherwise, or used to create derivative works.

Therefore, any reproduction, representation, publication, transmission or, in general, any unauthorized exploitation of all or part of the Website and the information disclosed therein shall be the responsibility of the User and could lead to legal action against him, both criminal and civil, as appropriate.

Updating and amendments

FocusEconomics reserves the right to correct possible errors present on the Website as soon as it becomes aware of them and, in general, to modify, at any time and without prior notice, all or part of the Website and its content, without being liable for this fact.

FocusEconomics reserves the right to modify the present Terms of Use at any time, without previous warning, being understood that such modifications will not be applied to the orders accepted before this modification. FocusEconomics is obliged to publish, in its case, the new general conditions in the Website.

Severability

If any provision of these Terms of Use is found to be unenforceable by law, the enforceability of any other part or provision of these Terms of Use shall not be affected.

Jurisdiction and Applicable Law

The interpretation, validity and execution of these Terms of Use, are governed by Spanish law. In all matters not provided for in these Terms of Use, shall be as provided in national and international legislation that is applicable.

Any dispute arising from the interpretation, validity and enforcement of these Terms of Use shall be subject to the Courts and Tribunals that are competent according to Spanish law.
